Abstract
The non-use of safety belts is almost always an offence; however no civil suitable guilt without further preface. The use or non-use of safety belts is not relevant when there is only material damage. The Dutch Company of Vehicle Insurers states that if the driver involved in an accident does not wear safety belts, this negligence can form an element of complicity in the consequences of an accident.
