Abstract

Two articles of the dutch road traffic act are outlined in detail. Article 25 prohibits a road user from behaving in such a way that the freedom of traffic is hindered without need or that safety on the road is endangered. Article 36 applies to those drivers of motor vehicles on whom guilt for the death or severe injury of another road user can be blamed. The history, court sentences and the jurisprudence of the two articles are discussed.
