Abstract

Following a brief discussion of the Federal Highway Administration's (FHWA) exposure to monetary tort liability, the paper turn to the effects upon research projects caused by the threat of litigation. Some examples of the latter are provided. Finally, the paper discusses the serious liability concerns that the development and application of Intelligent Vehicle Highway Systems (IVHS) poses for the FHWA, States and manufacturers of the technology.
