Abstract

Few practitioners are aware of the range of highways and occupiers liability claims. Despite the expense, there are positive aspects which manifest themselves in defending such claims. These will often be in the form of identifying systems or policies which are either inconsistent or which ignore available information. Mitigating against these factors can help to target scarce resources and ultimately improve safety. This paper outlines the vulnerability of authorities and how they can reduce their exposure.
