International product liability law : an update.

Abstract

This paper, published in bullet points in its computer slide format, provides an overview of product liability (PL) law across various countries, with case histories to illustrate points relevant to vehicle air bag manufacture. In the USA the Transportation Recall Enhancement, Accountability and Documentation (TREAD) Act applies, particular attention being paid here to the Early Warning and Foreign Defect reporting rules. New case law in Canada includes expanded duties to warn customers of even potential defects. Case studies from Spain are detailed where the manufacturer was deemed to be at fault on the allegation of the plaintiff. Similar case history in France is further discussed with reference to conflict between PL laws of Europe and France. The Lovells survey on European Union PL law, and the European Union 2001 General Product Safety/Information Law are outlined. Case law from Poland and proposed PL law changes in Turkey are illustrated by case history. New Korean PL laws, and Chinese rules on service of process and use of import bans, are described.
