Abstract

The Land Transport Management Act 2003 (LTMA) came into force on 13 November 2003. A year later, the Towards Sustainable Land Transport conference marks a useful opportunity to reflect on how, practically, the new legislation has impacted on New Zealand land transport planning and implementation, and possible future directions from a policy and legislative perspective. The author of this paper acts as legal advisor to a number of infrastructure organisations, including land transport providers, which has involved advice on LTMA and resource management issues. Issues to be examined in this paper include: 1. The relationship between the LTMA and other legislation, including the Resource Management Act; 2. The impact of new consultation requirements, including the introduction of consultation principles; 3. Changes to the funding process for land transport projects under the LTMA; and 4.
