Abstract

Increasing litigation and public concern with legal liability for accidents on icy and wet highways has stimulated interest in maintenance liability on the part of highway officials. The extant case law on the subject has established four areas 1) compliance with general duties in order to escape liability; 2) damages resulting from negligence; 3) contributory negligence as a bar to recovery by claimant, and 4) advisory signing as a technique in meeting general duties.
