Abstract

This paper examines the authors' experience in servicing expert witness commissions relating to third party liability claims filed as a result of alleged vehicular loss of control incidents occurring on freshly / recently laid spray seals. The paper will outline the common issues and factors seen in cases typically brought against the road authority in this area. The objective of the paper is to provide practitioners with a greater understanding of why any legal proceedings that result from such incidents can become highly contested in the court room.
