The breath test has been a subject for discussion during long times. In the Netherlands there exists now a legal basis for the use of breath test to detect the use of alcohol. In other countries there is still some doubt to introduce the introduction of the breath test as legal evidence. This paper presents the main points of the Dutch legislation for introduction.
