Since 1 June 1996, the Dutch Minister of Transport and Public Works (and the Central Driving License Issuing Authority (CBR) acting under the minister's authority) has been able to make an educational measure mandatory for drivers who have been apprehended by the police under suspicion of violating Article 8, Paragraph 2 of the Road Traffic Act of 1994 (WVW 94). This is a piece of legislation dealing with alcohol-related traffic offences. It is about an educational measure in the form of a course about alcohol and traffic, known as `The Alcohol and Traffic Educational Measure' (EMA).The SWOV Institute for Road Safety Research has carried out a process evaluation of how the EMA procedures have been operating internally. This assessment focused on the following elements: (1) The turning in of notices; (2) Decision-forming and processing; (3) The EMA course, including reporting the results in the form of a final report to the CBR's Collection Division (DV); and (4) the final decision. Based on the contents of the final report, the CBR decides whether the validity of the person's driving license will be upheld. The DV also informs the person about this decision. In case of an invalidation, the DV requests the person to turn in his/her driving license.
