The UK government plans to introduce a new scheme of graduated fixed penalties for offences relating to operating rules for commercial vehicles. A deposit scheme, applicable to non-UK-resident drivers, would ensure such drivers do not escape penalties. The provisions are designed to ensure the continued effective enforcement of drivers' hours rules and would be introduced at the earliest legislative opportunity. This document seeks comment from consultees on the principle of introducing a graduated fixed penalty scheme and a deposit scheme, on who can apply the scheme at the roadside, and on the proposals relating to the enforcement of drivers' hours rules. Sections included in the document are: how to respond; consultation questions; summary of proposals; graduated fixed penalties; the deposit scheme; rationalising the role of the enforcement agencies; drivers' hours rules; regulatory impact assessments; the consultation criteria; and a list of those organisations consulted.
