This report sets out a policy proposal for consultation on cross-jurisdictional governance arrangements under the Heavy Vehicle Driver Fatigue reform, and the reasons behind the policy. The paper has been developed following consultation with the transport regulators and using NTC’s previous experience with national reform processes. Aspects of the proposed governance arrangements include: a national approvals process to ensure consistent outcomes for those aspects of the reform that allow a degree of regulatory flexibility including Advanced Fatigue Management, exemptions from Standard Hours and electronic work diaries; reliance upon relatively prescriptive guidance materials and legislative provisions to ensure consistent outcomes for Basic Fatigue Management and the issue of written work diaries; enforcement guidelines to support consistent enforcement activity under the model legislation; use of mutual recognition and exchange of information provisions contained in the Compliance and Enforcement model legislation for the purposes of the fatigue reform; and inclusion of fatigue compliance information in the proposed national data exchange project outlined as part of the Council of Australian Governments (COAG) Reform Agenda.
