Progress made towards a single European railway market is reviewed, basedon the results of the European Commission funded project ERAIL (European Railways' Administration, Institutions and Legislation). A brief summary is given of the cumulative body of European Community laws relating to railways and the applicable standards. The ways in which Member States have implemented requirements relating to separation, licensing, and charging, interoperability and safety, state aid, competition and public service obligations, and statistics are considered. Conclusions are drawn as to the adequacy of the legislation and willingness of the Member States to implementit, the opening up of the market and the concept of reciprocity, the effects of the accession of the ten new Member States, and the development of future European policy/legislation framework for railways.
